C O N D I T I O N O F P A R T I C I P A T I O N

The organizer, SLD Event & Marketing GmbH, Leopoldstrasse 24/1, 6020 Innsbruck, Austria, organizes and manages the “INTERSPORT TESTIVAL” in 2024 on the Stubai Glacier. The participants of this event will be provided with sporting goods for testing purposes as part of this event. These sporting goods are provided by an exhibitor who operates a stand at the Testival. The workshops offered by the brand partners separately and outside of this testival (LVS, guided skiing, ...) are not part of this contract. These conditions of participation are now intended to regulate the legal relationship between the organizer and the participant within the framework of the “INTERSPORT TESTIVALS” in 2024.

With the signature overleaf, a participation contract is concluded between the organizer and participant and the participant accepts the present conditions of participation. In principle, only adults are eligible to participate. Persons who are not of legal age are only eligible to participate provided that they can provide proof of approval from their legal guardian and this signature declares their consent to take part in the testival. The participant expressly declares that the data provided by him is true. If it becomes known that one of these data has been deliberately provided incorrectly, the organizer is entitled to exclude the participant from further participation in the testival with immediate effect.

The participant acknowledges that the sporting goods made available to him are the property of the respective exhibitors and not the property of the organizer. The participant is obliged to return the sporting goods to the exhibitor immediately after testing and without unnecessary delay.

The participant is obliged to use the sporting goods provided by the exhibitors at all times and only on the marked slopes or those specified by the organizer. Participation in the workshops offered by the brand partners (LVS, Guided Skiing, ...) is at your own risk and risk. Participants are not allowed to go onto unpaved terrain or away from the marked pistes at any time with the sporting equipment provided. In addition, participants are obliged to comply with the relevant rules for sports-appropriate behavior, in particular the FIS rules, the requirements of the cable car operation and all other safety regulations.

The sporting goods provided by the exhibitors may only be used by the participant who has handed in their Testivalcard for the relevant sporting goods at the test stand. Passing on or providing the sporting goods to other people, such as other participants in the event, is not permitted - for whatever reason - otherwise the participant in question will have to bear the resulting adverse consequences themselves.

The participant is obliged to examine the sporting goods in detail before using them and to adequately understand their operation and safety mechanisms. Furthermore, the participant undertakes to use and store the sporting goods properly and carefully. In addition, the participant declares in advance that they will only use the sporting goods within the scope of their knowledge and skills. In particular, the participant is prohibited from using the sporting goods while intoxicated or otherwise consciously impaired. Furthermore, the participant is obliged to always carry the sports equipment with them and not to leave them unattended.

In the event of loss, theft, damage, destruction or other impairment of the sporting item, the participant must inform the exhibitor immediately and, in this case, will be liable to pay damages to the exhibitor of the sporting item in the amount of the full sales price.

The organizer is not liable to the participant for damage caused by his slight negligence, with the exception of personal injury. This also applies in particular to damage caused by or through the sporting goods or through their careless or improper use or as part of any participation in the workshops offered separately by the brand partners and not covered by the contractual relationship in question. The participant will indemnify and hold the organizer harmless in this regard. In the event that the event cannot be carried out due to force majeure, such as storm closures, avalanche risks, etc., the event ticket will be refunded by the organizer as a gesture of goodwill.

The participant also declares his express consent to the creation, processing, use and publication of images and video recordings in which the participant can be recognized by the organizer on the organizer's homepage for the purposes of advertising future similar events. The participant grants the organizer the unlimited, editable, non-exclusive and transferable right to advertising, marketing and PR. This right is granted free of charge. The participant is entitled to revoke this consent at any time. To do this, he must contact the organizer using the contact details given under point.

The place of fulfillment for the obligations arising from this contractual relationship between the organizer and the participant is 6167 Neustift im Stubaital, Austria.

For all disputes arising from or in connection with this contractual relationship, the exclusive place of jurisdiction is the court with local and factual jurisdiction for the organizer's registered office.

Austrian law applies exclusively to all legal relationships, including any disputes between the organizer and the exhibitor, excluding its reference standards and the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer within the meaning of the KSchG, the mandatory provisions of the country in which he has his habitual residence also apply to this contract.

The participant has a right of withdrawal in accordance with FAGG for contracts concluded via distance selling and off-premises. The participant can withdraw from the contract within 14 days without giving reasons. The deadline begins on the day the contract is concluded. The deadline is met if the participant sends the declaration of withdrawal within the deadline. The participant's declaration is not bound to any form and can be sent to the contact points specified under point 1 of these conditions of participation. However, in accordance with § 18 Paragraph 1 Z 1 FAGG, the participant loses his right of withdrawal if he has confirmed before the start of the service provision that he has taken note of the fact that he will lose his right of withdrawal once the contract has been fully fulfilled. The consumer hereby confirms that he has expressly acknowledged that he will lose his right of withdrawal once the contract has been fully fulfilled.
